These Terms & Conditions explain the terms that apply when you use our website, download our resources, purchase our digital products or programmes, join a membership, participate in online fitness or wellbeing content, or otherwise purchase or use services provided by The Midlife Thrive Club.
The Midlife Thrive Club is operated by Donna Cuthbertson in the United Kingdom.
By purchasing, accessing or using our paid products or services, you agree to these Terms & Conditions. Where a particular programme, event, membership, retreat or other service has additional terms, those terms will also apply and will be made available before purchase or booking.
The Midlife Thrive Club may provide products and services including:
Free guides, challenges, downloads and resources.
Ebooks and other digital products.
Online and on-demand fitness and wellbeing content.
Courses, workshops and programmes.
Memberships and subscriptions.
Live online sessions and events.
Other midlife fitness, wellbeing and educational services.
The exact content, duration, access period and price of a paid product or service will be described on the relevant sales or checkout page.
Prices will be clearly displayed before purchase.
Payment is taken through the payment provider shown at checkout. You agree to provide accurate and current payment and contact information when making a purchase.
Where a product is offered through instalments or recurring payments, the payment schedule and amount will be made clear before you purchase.
We reserve the right to change prices for future purchases. A price change will not retrospectively alter a purchase you have already made, except where changes to an ongoing subscription are made in accordance with applicable law and you are notified as required.
Some of our products are supplied digitally, including ebooks, downloadable resources, recorded workouts, programmes and other online content.
Where you choose to receive digital content immediately, before the end of any statutory cancellation period, you may be asked at checkout to expressly consent to immediate supply and acknowledge that your statutory right to cancel may be lost once supply of the digital content begins.
Nothing in these Terms & Conditions affects any statutory rights you have under UK consumer law.
Refund and cancellation rights vary depending on the type of product or service purchased and your statutory rights.
Any specific cancellation or refund terms applying to a programme, membership, event or service will be clearly communicated before purchase where required.
For digital content supplied immediately, your statutory cancellation right may be lost once supply begins where you have expressly agreed to immediate supply and acknowledged the loss of that cancellation right.
If digital content is faulty, not as described or cannot be accessed as promised, your statutory consumer rights still apply.

Where The Midlife Thrive Club offers a recurring membership or subscription, the price, billing frequency and any minimum commitment will be explained before you join.
Recurring payments will continue in accordance with the terms presented when you purchase until the membership or subscription is cancelled or otherwise ends.
Instructions for cancelling will be provided with the relevant membership information.
Any cancellation will be handled in accordance with the terms presented when you joined and your applicable statutory rights.
The Midlife Thrive Club provides general fitness, movement, wellbeing and educational content. It is not intended to replace individual medical advice, diagnosis or treatment.
You are responsible for deciding whether an activity is suitable for you and for exercising within your own capabilities.
If you have a medical condition, injury, are pregnant, have recently given birth, are recovering from illness or surgery, are experiencing unexplained symptoms, or have any concern about whether exercise is appropriate for you, you should seek appropriate advice from a qualified healthcare professional before participating.
Stop exercising if you feel unwell, faint, dizzy, experience unusual pain, chest pain, severe shortness of breath or any other concerning symptoms and seek appropriate medical assistance where necessary.
Where modifications or alternatives are demonstrated, you remain responsible for choosing an appropriate level for your circumstances.
Participation in any exercise activity carries inherent risks. Nothing in these Terms seeks to exclude or limit liability where doing so would be unlawful.
Information provided through The Midlife Thrive Club about menopause, midlife health, nutrition, exercise, wellbeing or related topics is provided for general educational purposes.
It should not be regarded as personalised medical, nutritional, psychological or other healthcare advice.
We aim to provide useful and responsible information, but individual circumstances vary and information may change as research and professional guidance develops.
This bit is particularly important.
Unless otherwise stated, the content created for The Midlife Thrive Club — including ebooks, free resources, guides, challenges, worksheets, programmes, workout plans, videos, recordings, photographs, graphics, written materials, course content, website content and other original materials — is owned by or licensed to The Midlife Thrive Club and is protected by applicable intellectual property laws.
Purchasing or downloading our content gives you a personal, non-exclusive, non-transferable licence to use it for your own personal use only. Ownership of the content does not transfer to you.
You must not, without prior written permission:
Copy or reproduce our content except for reasonable personal use.
Share purchased or members-only content with another person.
Upload our resources, ebooks, videos or programme materials to another website, platform, group or file-sharing service.
Sell, licence, distribute or give our content to others.

Free resources are still protected by copyright. Receiving a resource free of charge does not transfer ownership or grant permission to reproduce, redistribute, sell, rebrand or commercially exploit it.

Where a product or membership provides a personal login, your login details are for your use only.

Retreats, residential experiences and certain events may have their own booking terms covering matters such as deposits, payment schedules, cancellation, accommodation, travel and participant requirements.

Subject to applicable law, we are not responsible for losses that were not reasonably foreseeable when our agreement with you was formed or losses arising from circumstances outside our reasonable control.

Where a community element is provided, we may remove content or restrict access where reasonably necessary to protect participants or the service.
